General terms and conditions - B2C monitoring service

These General Terms and Conditions govern the purchase and use of the job offer monitoring and reporting service offered through this website by Marco Salerno, with registered address at Via Prenestina 42, 00176 Rome RM, Italy, VAT number 17886761000, Email: assistenza@marco-salerno.it (hereinafter the "Provider").
1. Subject of the Service
The service consists of the daily monitoring, selection and indexing of job offers available online, consistent either with the search criteria indicated by the user or with pre-set criteria defined by the service (the "Customer"). The service is strictly reserved for private consumers (B2C). The Provider merely collects and filters data available on the web, making it available to the Customer within the private area of the website.
Purchasable services may include, by way of example, custom searches based on the role and area indicated by the Customer, or services based on standard pre-set criteria, such as job offers with food and/or lodging in Italy or job offers in Italy suitable for English-speaking candidates. In all cases, the service concerns the reporting of job offers published online: the Provider does not submit applications on behalf of the Customer, does not replace the Customer's own application activity and does not guarantee interviews, employment or direct contact with companies.
2. Duration and Service Delivery Calendar
The service lasts for the period indicated on the purchase page. The custom search can be purchased for 1 week, equal to 5 effective working days, or for 4 weeks, equal to 20 effective working days. Other services last for the period specified on their purchase page.
Italian national holidays are considered scheduled inactivity days. If service delivery is interrupted due to holidays or justified technical or organizational needs of the Provider, the duration will be automatically extended by as many working days as the inactivity days, guaranteeing the number of working days included in the purchased option. The service does not renew automatically; at the end of the selected duration, delivery ceases unless the Customer makes a new purchase.
The number of compatible job offers depends on the offers actually available online and on the criteria provided by the Customer. A day on which the search and filtering activities are regularly carried out counts as a working day of service even when no compatible offers are identified.
3. Price and Payment Method
The price of the service is the one indicated on the website at the time of purchase. Payment is made in a single advance payment through the secure Stripe platform, unless different manual arrangements are agreed directly with the Provider.
The purchase may also take place through links containing referral or affiliate codes, used exclusively for commercial attribution and internal reporting purposes.
4. Right of Withdrawal and Immediate Start (Italian Consumer Code)
Pursuant to Art. 52 of the Italian Consumer Code, the Customer has the right to withdraw from the contract within 14 days of purchase without providing reasons.
However, by making the purchase, the Customer expressly requests the immediate start of the service before the withdrawal period expires.
In accordance with Art. 57, paragraph 3 of the Italian Consumer Code, in case of withdrawal exercised within the first 14 days from purchase, the Customer will not be entitled to a full refund, but an amount proportional to the working days of service already actually used up to the time of the withdrawal notice will be retained. Each working day already carried out will be valued proportionally to the number of working days included in the purchased option. Saturdays and Sundays will not be counted in the retention calculation. The remaining amount will be refunded through the same payment method used, where technically possible, or through a method agreed with the Customer.
5. Disclaimer of Liability
The Provider selects job postings in good faith from public online sources, but does not exercise any control over the companies publishing them. The Provider does not guarantee the accuracy, truthfulness, persistence or lawfulness of such postings, nor does it in any way guarantee that the user will obtain interviews or jobs. Applications, CV submission, contact with companies and verification of the quality and authenticity of the job offer remain the sole responsibility of the Customer. The Provider is not responsible for any scams, damages or disputes between the Customer and third-party companies.
6. Data Retention and Access Suspension
At the end of the working days included in the purchased option, in the absence of renewal, the sending of new job offers stops. The Customer may continue to access the website to consult the history of offers already received for a maximum and mandatory period of 30 days from expiry. After this period, the offers entered in the private area will be deleted.
The Customer's account (credentials and personal data) will remain active to facilitate future purchases for a period of 24 months from the last activity (last purchase or last login), after which it will be permanently deleted as provided in the Privacy Policy.
7. Applicable Law and Jurisdiction
This contract is governed by Italian law. For any dispute relating to the interpretation or execution of the contract, the court of the consumer's residence or domicile shall have jurisdiction.
